These Terms of Service (“Terms”) govern your use of the CatchUp – Supplement Tracker iOS application (the “App”) and the website becatch.app, both published by Przemysław Raciborski (“we”, “us”). Contact: support@becatch.app.
By downloading or using the App, you agree to these Terms and to Apple's Licensed Application End User License Agreement (the “Standard EULA”). Where the two conflict, these Terms prevail to the extent the Standard EULA allows.
1The App
CatchUp is a pill reminder and tracker. It helps you plan, get reminders for and log your supplements, vitamins and medications, and track your remaining supply. The App works without an account and stores your data locally on your device, as described in our Privacy Policy.
2Not medical advice
Important: CatchUp is a reminder and tracking tool. It is not a medical device and doesn't provide medical advice, diagnosis or treatment.
- You decide what to add to the App: which medications and supplements, the doses and the schedule. CatchUp doesn't recommend or check medications, doses or combinations.
- Always take medications and supplements as your doctor, pharmacist or the product label tells you. Ask them before you start, change or stop anything.
- Reminders depend on your device, iOS notification settings, battery and other things outside our control, and may occasionally not arrive. Don't rely on the App as your only reminder for anything health-critical.
- Supply counts and refill alerts are based only on the numbers you enter. Make sure you reorder medications in time.
In a medical emergency, contact your doctor or local emergency services immediately.
3Eligibility
You must be at least 16 years old, or the age of digital consent in your country, to use the App. If you're under the age of majority, you may use the App only with a parent or guardian involved.
4License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, as the Standard EULA and the App Store Usage Rules permit. You may not copy, modify, reverse-engineer, resell or distribute the App or its content, except where the law allows it.
5Subscriptions and in-app purchases
Some features require a paid premium subscription (“CatchUp Pro”). You buy it through Apple's App Store, which handles the purchase; we use RevenueCat to check your subscription status.
Billing
Apple IDYour Apple ID account is charged when you confirm the purchase. Prices are shown in the App before you buy and may vary by country. If a subscription price changes, the new price applies no earlier than your next renewal, and Apple notifies you as its rules require. Purchases unlock features in the App and have no cash value.
Auto-renewal
AutomaticYour subscription renews automatically for the same period and price unless you turn off auto-renew at least 24 hours before the current period ends. The renewal charge is made within the 24 hours before the current period ends.
Free trials
If offeredA free trial becomes a paid subscription when it ends unless you cancel at least 24 hours before the end of the trial. If you buy a subscription during a trial, any unused part of the trial is forfeited.
Manage or cancel
AnytimeGo to Settings → [your name] → Subscriptions on your device, or to your App Store account settings. Deleting the App does not cancel your subscription.
Refunds
Via AppleApple processes all payments, so request refunds from Apple at reportaproblem.apple.com. Apple's policies apply. We can't issue refunds directly.
Restore purchases
New deviceTo restore an active subscription on a new device, sign in with the same Apple ID and use “Restore purchases” in the App.
Nothing in these Terms limits mandatory consumer rights you have in your country, including statutory withdrawal rights where they apply.
6Your data and backups
Your plans and logs are stored only on your device. We don't keep a copy, so we can't restore them if you delete the App or reset or lose your device. You're responsible for keeping your own device backups.
7Acceptable use
You agree not to misuse the App. This includes trying to get around subscription checks, interfering with how the App works, or using it for anything unlawful.
8Intellectual property
We or our licensors own the App, including its design, text, graphics, animations and software, and intellectual property laws protect it. “CatchUp” and related logos are our marks. We may use feedback you send to improve the App, with no obligation to you.
9Third-party services and links
The App relies on third-party services (Apple, RevenueCat, Sentry) and may link to external websites. We're not responsible for third-party content or services; their own terms apply.
10Disclaimer of warranties
To the maximum extent the law allows, we provide the App “as is” and “as available”, without express or implied warranties of any kind. This includes warranties of fitness for a particular purpose, accuracy of content, and uninterrupted or error-free operation. We don't guarantee any particular health, fitness or wellness result.
11Limitation of liability
To the maximum extent the law allows, we're not liable for any indirect, incidental, special or consequential damages. We're also not liable for any health outcome or for decisions you make based on information in the App. Our total liability for any claim relating to the App is limited to what you paid for the App in the 12 months before the claim.
Nothing in these Terms excludes or limits liability that the law doesn't allow us to exclude. This includes liability for intent or gross negligence, and for death or personal injury caused by negligence.
12Termination
You can stop using the App at any time by deleting it; remember to cancel any subscription separately. We may suspend or discontinue the App or any feature at any time. Sections that by their nature should survive termination will survive.
13Changes
We may update these Terms from time to time. The “Last updated” date shows the latest version. If you keep using the App after changes take effect, you accept the updated Terms.
14Governing law
The laws of Poland govern these Terms, without affecting mandatory consumer protection rules in your country of residence. Disputes will go to the courts that have jurisdiction under applicable law.
15Apple
The App is distributed through the Apple App Store. As Apple requires, the following applies:
- These Terms are between you and us, not Apple. Apple isn't responsible for the App or its content.
- Your license is limited to Apple-branded devices you own or control, as allowed by the App Store Terms of Service, including the Usage Rules.
- We, not Apple, are responsible for maintenance and support of the App (contact below). Apple has no obligation to provide any maintenance or support.
- If the App doesn't conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent the law allows, Apple has no other warranty obligation for the App.
- We, not Apple, are responsible for any claims relating to the App, including:
- product-liability claims;
- claims that the App fails to meet legal or regulatory requirements;
- consumer-protection claims;
- intellectual-property infringement claims.
- You confirm that you are not located in a country subject to a U.S. government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. government list of prohibited or restricted parties.
- You must comply with any applicable third-party terms when using the App, such as your wireless data agreement.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, may enforce them against you.
